The Process of ERISA

It is not uncommon for Long Term Disability claims to be wrongfully terminated by insurance companies.

Many LTD claims are terminated after 24 months, when the definition of “disability” in the policy changes to whether you can perform your “own occupation” to whether you can perform “any occupation.” Sometimes claims are terminated based on surveillance or for completely arbitrary reasons.

We charge a percentage of the past-due benefits (“back pay”) and all future monthly benefits are 100% yours, free and clear.

If your appeal is not successful, we will file suit against the insurance company on your behalf. Most litigated Long Term Disability claims are settled. That is, you agree to dismiss the lawsuit and release the insurance company in exchange for a lump sum payment. We charge a percentage of the settlement. If there is no recovery, you owe us nothing.
